Bipartisan Infrastructure Law

The Bipartisan Infrastructure Law (BIL) is providing GEFA’s Water Resources Division with additional funding through the U.S. Environmental Protection Agency (EPA). GEFA’s BIL funding for water and wastewater infrastructure projects is provided below.

Clean Water State Revolving Fund (CWSRF) (supplemental funding)

  • Funding for Federal Fiscal Year 2022 - $30,092,000
  • Funding for Federal Fiscal Year 2023 - $35,242,000
  • BIL requires that 49 percent of the CWSRF supplemental funding be provided as grants and forgivable loans to communities that meet the state’s affordability criteria or certain project types consistent with the Clean Water Act (CWA).

CWSRF Emerging Contaminants

  • Funding for Federal Fiscal Year 2022 - $1,581,000
  • Funding for Federal Fiscal Year 2023 - $3,632,000
  • BIL requires amount to be 100 percent of the capitalization grant and/or principial forgiveness.  Additional subsidization may be provided to any eligible CWSRF assistance recipient for any project eligible under Section 603(c) of the CWA that addresses emerging contaminants.

Drinking Water State Revolving Fund (DWSRF) (supplemental funding)

  • Funding for Federal Fiscal Year 2022 - $42,400,000
  • Funding for Federal Fiscal Year 2023 - $57,090,000
  • BIL requires 49 percent of the DWSRF supplemental funding be provided as grants and forgivable loans, and it provides flexibility to meet local water needs and to ensure disadvantaged communities benefit equitably.

DWSRF Emerging Contaminants

  • Funding for Federal Fiscal Year 2022 - $17,804,000
  • Funding for Federal Fiscal Year 2023 - $20,716,000
  • BIL requires at least 25 percent of the DWSRF Emerging Contaminants funding be provided as grants and forgivable loans to disadvantaged communities or public water systems serving fewer than 25,000 people.

DWSRF Lead Services Line Replacement

  • Funding for Federal Fiscal Year 2022 - $66,808,000
  • Funding for Federal Fiscal Year 2023 - $28,660,000
  • The required initial statewide lead service line inventory deadline is October 16, 2024.
  • EPA will share models, guidance, and build state capacity to assist local communities and to ensure lead service line funding is effectively and equitably deployed.
  • Any project under this appropriation must replace the entire lead service line, not just a portion, unless a portion has already been replaced.

Emerging Contaminants in Small or Disadvantaged Communities Grant

  • Funding for Federal Fiscal Year 2023 - $54,572,000 (combined with Federal Fiscal Year 2022)
  • Funding to address emerging contaminants in drinking water in small or disadvantaged communities.

Sewer Overflow and Stormwater Reuse Municipal Grant

  • Funding for Federal Fiscal Year 2023 - $2,985,500
  • Funding for planning, design, and construction of combined sewer overflows (CSOs), sanitary sewer overflows (SSOs), and stormwater management projects.
